This reform clearly undermines democratic counterweights by limiting unions\u2019 ability to debate, challenge, intervene and defend their members.<\/strong><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2b55a37 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2b55a37\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-adc37a6\" data-id=\"adc37a6\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-e8a072d elementor-widget elementor-widget-text-editor\" data-id=\"e8a072d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>\u201cBill 3 is part of a larger trend aimed at weakening those who, in a democratic society, are specifically tasked with questioning, debating, and holding power to account,\u201d says Madeleine Pastinelli, president of the FQPPU. \u201cTaken individually, several of the bill\u2019s measures may seem technical, even legitimate; but the reform as a whole risks seriously eroding our democracy.\u201d<\/p><p>The Federation\u2019s brief demonstrates that Bill 3 introduces unprecedented\u2014and unworkable\u2014mechanisms that restrict freedom of association, hinder unions\u2019 ability to defend members\u2019 interests in court, establish an arbitrary double-accounting requirement, and create an administrative burden that diverts union resources from their core mission.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-486904b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"486904b\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-d4f27c5\" data-id=\"d4f27c5\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-2186977 elementor-widget elementor-widget-text-editor\" data-id=\"2186977\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><strong>Interference in the democratic organization of associations<\/strong><\/h4><p>The bill imposes referendum rules likely to weaken participation in democratic debate\u2014an essential element of union life. Even more troubling, it extends voting rights to non-members, creating a situation unique in Quebec by requiring unions to grant voting rights to people who are not members (section 1, pp. 5\u20137)<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-7ebb9df elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"7ebb9df\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-e929d07\" data-id=\"e929d07\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-620c5fe elementor-widget elementor-widget-text-editor\" data-id=\"620c5fe\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><strong>Restrictions based on unjustified, vague and unworkable distinctions<\/strong><\/h4><p>The bill requires a split between \u201cprincipal dues\u201d and \u201coptional dues\u201d\u2014a mechanism based on categories that cannot be clearly defined (section 2, pp. 8\u201316). These restrictions:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2cdf67f elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2cdf67f\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-935e107\" data-id=\"935e107\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>limit unions\u2019 ability to challenge certain laws, even when fundamental rights are at stake;<\/li><li>restrict their participation in litigation affecting members\u2019 social or economic rights;<\/li><li>introduce so much vagueness that unions could be sanctioned for activities impossible to identify in advance.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2eb5e4b elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2eb5e4b\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-20d43fb\" data-id=\"20d43fb\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This vagueness is so severe that it violates the principles of fundamental justice established by the Supreme Court (p. 14).<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-2c169c3 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"2c169c3\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-4eba68d\" data-id=\"4eba68d\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-dbfac97 elementor-widget elementor-widget-text-editor\" data-id=\"dbfac97\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><strong>FQPPU recommendations<\/strong><\/h4><p>The Federation therefore calls for the withdrawal of the bill, or at the very least:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-fa598aa elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fa598aa\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-3b2edfc\" data-id=\"3b2edfc\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-b91b0ef elementor-widget elementor-widget-text-editor\" data-id=\"b91b0ef\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>the removal of the proposed new articles 20.1.1, 20.3.2 and 47.0.1 to 47.0.5 of the <em>Labour Code<\/em>, as well as all references to these articles in other provisions;<\/li><li>the removal of the words \u201cand present them at a meeting to the members of the certified association that is affiliated with or belongs to it\u201d from new article 47.1, para. 3 of the <em>Labour Code<\/em>.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b4c1767 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b4c1767\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h4><strong>A threat to counter-powers and to the university mission<\/strong><\/h4><p>For faculty unions represented by the Federation, the effects would be severe:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-cacf4f1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"cacf4f1\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-09bb1c8\" data-id=\"09bb1c8\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ul><li>limits on their ability to defend the university mission;<\/li><li>obstacles to contesting legislative measures that infringe on academic freedom;<\/li><li>a shrinking civic space for critical voices that are essential to public debate.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-86e7728 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"86e7728\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The FQPPU therefore urges the government to withdraw Bill 3 or, at the very least, to remove the provisions most anathema to union democracy. It reaffirms its willingness to collaborate on any reasonable review of the legislative framework, provided it respects the freedom of association, the essential role of democratic counterweights, and the overall democratic health of Quebec.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-37b4b9d elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"37b4b9d\"
